Jim Thomson, II obtained a voluntary dismissal of a claim for personal injury against a road maintenance company based on an unopposed motion for summary judgment. The plaintiff claimed he sustained injuries due to a fall stemming from inadequate snow and ice removal. The road maintenance company argued in its summary judgment motion that it did not owe any duty to the plaintiff because it did not own or control the land on which the plaintiff fell, nor was it instructed to perform any snow or ice removal in the time leading up to the plaintiff’s accident. Due to the arguments presented, the plaintiff voluntarily dismissed the road maintenance company.
